In the case of personal collection of a product that is in stock, payment is made in advance by invoice or in cash with us, subject to the legal limits of EUR 5,000.00 for a natural person and EUR 420.00 for a legal person (applies to the Republic of Slovenia).

If you want to order the product via Pošta Slovenije (lighter products) or order delivery (lighter or heavier products), the product is paid for on a pro-forma invoice, including postage costs or delivery.

CUSTOM PRODUCTS

In the case of custom-made products and products that include delivery and assembly, payment is made via pro forma invoice.

Products that are delivered to order cannot be returned.

The customer can check the suitability of the product at the company's location before purchasing. Return of used items is not possible.

The delivery of goods is provided by Pošta Slovenije, other external carriers or the delivery company IKI PRO. The delivery company IKI-PRO and other external carriers usually deliver within 5 working days.

The contractual partners for the delivery of shipments are Pošta Slovenije and an external carrier, but the provider reserves the right to choose another delivery service if this will fulfill the order more efficiently.

Delivery and Acceptance of Goods
By making a purchase, the customer agrees that the company IKI-PRO d.o.o. may carry out the delivery either by itself or through an external delivery service on any day, regardless of the customer's presence at the delivery address. If the customer is not present at the specified address (billing address or another address provided by the customer at the time of ordering), IKI-PRO d.o.o. reserves the right to leave the goods at the customer's address, which shall be considered as successfully delivered. The company does not assume responsibility for potential theft, damage due to weather conditions, or other circumstances that may occur after the goods have been placed at the delivery address, as these are not subject to complaints.

If the customer does not ensure unloading despite the agreement (DAP offer or written agreement via email), we reserve the right to charge for redelivery in full.

  1. Right to withdraw from the contract

In the case of distance contracts, the consumer (natural person) has the right to notify the company within 14 days of receipt of the goods that he/she withdraws from the contract, without having to state the reason for his/her decision, in accordance with Article 43.č of the ZVPot . The only cost borne by the consumer in connection with the withdrawal from the contract is the direct cost of returning the goods.

 

WITHDRAWAL FROM THE CONTRACT

The right to withdraw from the contract is granted in accordance with the Consumer Protection Act and covers natural persons, but not companies or legal entities.
The entire cost of shipping and/or returning the goods in the event of a return is borne by the buyer; in the event of withdrawal from the contract, the company shall immediately or at the latest within 14 days of receiving the notice of withdrawal from the contract, refund all payments received.
The company shall refund the payments received to the consumer using the same means of payment as the consumer used, unless the consumer has expressly requested the use of another means of payment and the consumer does not bear any costs as a result.
In the case of sales contracts, the company may withhold the refund of payments received until the returned goods have been received and checked that everything is in order with the goods.
If you have received damaged goods, take a photo of them immediately, directly upon receipt of the shipment. If you have received unsuitable goods, you may return them within the statutory period of 14 days after receipt of the goods, and the goods must be unused, packed in the original packaging and undamaged. The purchase price will be refunded to the buyer in a pre-agreed manner, no later than 14 working days from the return of the goods.

The buyer must return the received goods undamaged and in the same quantity, unless the goods are destroyed, damaged, lost or their quantity has decreased through no fault of the consumer.

When it comes to the right to withdraw from a contract concluded at a distance, it is important to know that this is a withdrawal from the contract, without there being anything wrong with the thing itself, but rather this right belongs to the consumer due to the very nature of the contract - the conclusion of a distance contract. The right to withdraw from the contract is not about the consumer not knowing what he is buying (in principle, the consumer also knows what he is ordering in other things), but simply about him thinking about his decision within the legally prescribed period and, in the event that this decision was hasty, changing his decision and withdrawing from the contract.

It is also important to note that concluding a distance contract does not give the consumer more rights than concluding a contract in a traditional way (i.e. by visiting a store). Thus, the consumer cannot and may not use the received goods without hindrance at all times until the contract is withdrawn, as this is not a trial purchase, where testing the goods would be a condition for maintaining the contract in force. The consumer may therefore only inspect and test the received goods to the extent strictly necessary to determine the actual situation and as is customary in stores. Any "testing" that deviates from the above can be considered use of the goods, which means that the consumer thereby loses the right to withdraw from the contract.

The right to withdraw from the contract does not give the consumer any further rights, but only the possibility to reconsider their purchase decision even after receiving the goods and, if this decision was hasty, to change their decision and withdraw from the contract, but it does not give them the right to use the goods.

The claimed product must be sent to our company address in perfect condition or sent in the same way as it was received, at the buyer's expense, in accordance with our warranty terms published on our website and below in our terms and conditions.

IMPORTANT: All packages sent to our address with cash on delivery or postage paid by the recipient, etc., will be refused and returned to the sender at their expense.

For each possible missing part of the product or for missing accessories, the deduction from the total purchase price of the product is assessed separately. We allow the possibility that in the case of a returned incomplete product, regardless of the type of complaint or return, we will not accept it. In the event that you wish to have the purchase price refunded during the complaint procedure, the product complained about will once again become the property of IKI-PRO doo after the purchase price has been refunded. If the product is not returned to our address in the same condition as it was sent to the customer's address, any change to the product represents business damage for IKI-PRO doo.

When the product with all the accompanying documentation arrives at the address of the company IKI-PRO doo, it will be inspected by the complaints department. Depending on the content of the completed complaint report and the findings of the complaint inspection, a company representative will contact you and inform you of the further procedure.

Each case will be handled individually, depending on the type of complaint. During the process, the complaints department may offer you a product repair, product replacement, or refund.

Important:

All working products that were sent to our address as claimed and no defects were discovered during the complaint inspection will be returned at the customer's expense after prior payment of the costs via pro forma invoice.

The cost for an unjustified product inspection is considered to be a minimum of 1 service hour in the amount of EUR 40.00 + VAT (product inspection) and shipping costs.

All products leave our distribution center in protective packaging and in perfect condition. Please note that the package will be delivered in perfect condition. If you notice obvious damage to the package upon receipt, you are not obliged to accept such a package and can refuse it. Please also inform us about the rejection of the package due to damage. You must understand that IKI-PRO doo cannot be held responsible for damage to the package after delivery. In the event that the customer receives a damaged package, IKI-PRO doo cannot know whether it was actually damaged upon receipt or whether the damage occurred after receipt. In the latter case, IKI-PRO doo cannot guarantee that the customer can return the package and receive a refund.

Goods ordered on the website will be delivered to you as soon as possible. Orders received on weekdays will be shipped the same or the next business day after receiving the payment (if the product is in stock). If the ordered goods are out of stock, we will notify you immediately. The delivery of the goods is handled by Pošta Slovenije, an external carrier or IKI PRO delivery. Although we try to provide accurate photos of the items for sale, all photos should be taken as symbolic. Photos do not guarantee product properties. Color shades and appearance may differ slightly from the actual condition of the products.

The delivery of goods is provided by Pošta Slovenije, other external carriers or the delivery company IKI PRO. Pošta Slovenije usually delivers the next working day after the shipment is dispatched, but no later than within 3 days of dispatch. The delivery company IKI-PRO and other external carriers usually deliver within 5 working days.

The contractual partners for the delivery of shipments are Pošta Slovenije and an external carrier, but the provider reserves the right to choose another delivery service if this will fulfill the order more efficiently.

  1. Right to withdraw from the contract

In the case of distance contracts, the consumer (natural person) has the right to notify the company within 14 days of receipt of the goods that he/she withdraws from the contract, without having to state the reason for his/her decision, in accordance with Article 43.č of the ZVPot . The only cost borne by the consumer in connection with the withdrawal from the contract is the direct cost of returning the goods.

 

WITHDRAWAL FROM THE CONTRACT

The right to withdraw from the contract is granted in accordance with the Consumer Protection Act and covers natural persons, but not companies or legal entities.
The entire cost of shipping and/or returning the goods in the event of a return is borne by the buyer; in the event of withdrawal from the contract, the company shall immediately or at the latest within 14 days of receiving the notice of withdrawal from the contract, refund all payments received.
The company shall refund the payments received to the consumer using the same means of payment as the consumer used, unless the consumer has expressly requested the use of another means of payment and the consumer does not bear any costs as a result.
In the case of sales contracts, the company may withhold the refund of payments received until the returned goods have been received and checked that everything is in order with the goods.
If you have received damaged goods, take a photo of them immediately, directly upon receipt of the shipment. If you have received unsuitable goods, you may return them within the statutory period of 14 days after receipt of the goods, and the goods must be unused, packed in the original packaging and undamaged. The purchase price will be refunded to the buyer in a pre-agreed manner, no later than 14 working days from the return of the goods.

The consumer must return the goods within 14 days of the notified intention to withdraw from the contract. The company must make the refund as soon as possible, but no later than 14 (fourteen) days after receiving the notification of withdrawal from the contract.

The buyer must return the received goods undamaged and in the same quantity, unless the goods are destroyed, damaged, lost or their quantity has decreased through no fault of the consumer.

To make it easier to understand the rights to return products, we are providing an explanation from the Market Inspectorate (source: Information - Bulletin of the Chamber of Commerce of Slovenia, January 20, 2012, issue 3):

When it comes to the right to withdraw from a contract concluded at a distance, it is important to know that this is a withdrawal from the contract, without there being anything wrong with the thing itself, but rather this right belongs to the consumer due to the very nature of the contract - the conclusion of a distance contract. The right to withdraw from the contract is not about the consumer not knowing what he is buying (in principle, the consumer also knows what he is ordering in other things), but simply about him thinking about his decision within the legally prescribed period and, in the event that this decision was hasty, changing his decision and withdrawing from the contract.

It is also important to note that concluding a distance contract does not give the consumer more rights than concluding a contract in a traditional way (i.e. by visiting a store). Thus, the consumer cannot and may not use the received goods without hindrance at all times until the contract is withdrawn, as this is not a trial purchase, where testing the goods would be a condition for maintaining the contract in force. The consumer may therefore only inspect and test the received goods to the extent strictly necessary to determine the actual situation and as is customary in stores. Any "testing" that deviates from the above can be considered use of the goods, which means that the consumer thereby loses the right to withdraw from the contract.

The right to withdraw from the contract does not give the consumer any further rights, but only the possibility to reconsider their purchase decision even after receiving the goods and, if this decision was hasty, to change their decision and withdraw from the contract, but it does not give them the right to use the goods.

The online store iki-stroji.si reserves the right to refuse the return of a damaged, used product or a product that does not contain all the associated elements (box, invoice, original packaging, unused, etc.) at the sender's expense. Our complaints department requires all the information marked on the complaint record when examining an individual product. In case of missing information, we will contact you again in the same way as you contacted us at the beginning of the complaint procedure, which may result in the complaint procedure being extended.

The claimed product must be sent to our company address in perfect condition or sent in the same way as it was received, at the buyer's expense, in accordance with our warranty terms published on our website and below in our terms and conditions.

IMPORTANT: All packages sent to our address with cash on delivery or postage paid by the recipient, etc., will be refused and returned to the sender at their expense.

For each possible missing part of the product or for missing accessories, the deduction from the total purchase price of the product is assessed separately. We allow the possibility that in the case of a returned incomplete product, regardless of the type of complaint or return, we will not accept it. In the event that you wish to have the purchase price refunded during the complaint procedure, the product complained about will once again become the property of IKI-PRO doo after the purchase price has been refunded. If the product is not returned to our address in the same condition as it was sent to the customer's address, any change to the product represents business damage for IKI-PRO doo.

When the product with all the accompanying documentation arrives at the address of the company IKI-PRO doo, it will be inspected by the complaints department. Depending on the content of the completed complaint report and the findings of the complaint inspection, a company representative will contact you and inform you of the further procedure.

Each case will be handled individually, depending on the type of complaint. During the process, the complaints department may offer you a product repair, product replacement, or refund.

Important:

All working products that were sent to our address as claimed and no defects were discovered during the complaint inspection will be returned at the customer's expense after prior payment of the costs via pro forma invoice.

The cost for an unjustified product inspection is considered to be a minimum of 1 service hour in the amount of EUR 40.00 + VAT (product inspection) and shipping costs.

All products leave our distribution center in protective packaging and in perfect condition. Please note that the package will be delivered in perfect condition. If you notice obvious damage to the package upon receipt, you are not obliged to accept such a package and can refuse it. Please also inform us about the rejection of the package due to damage. You must understand that IKI-PRO doo cannot be held responsible for damage to the package after delivery. In the event that the customer receives a damaged package, IKI-PRO doo cannot know whether it was actually damaged upon receipt or whether the damage occurred after receipt. In the latter case, IKI-PRO doo cannot guarantee that the customer can return the package and receive a refund.

  1. In the event of visible damage to the packaging or goods, the buyer's complaint must be made to the provider or delivery service upon receipt of the goods. The buyer is not obliged to accept such goods and may refuse the shipment.

When is a mistake real?

When:

  • the item does not have the properties necessary for its normal use or for circulation
  • the item does not have the properties necessary for the specific use for which the buyer is purchasing it, but which were known to the seller or should have been known to him
  • the item does not have the properties and characteristics that were explicitly or tacitly agreed upon or prescribed
  • the seller delivered an item that does not match the sample or model, unless the sample or model was shown only for the purpose of notification.

How is the suitability of an item checked?

It is checked with another, flawless item of the same type, as well as with the manufacturer's statements or statements on the item itself.

How is a factual error enforced?

The buyer must notify us of any material defect, along with a detailed description of it, at their own expense, within the legally prescribed period or according to the warranty conditions in the case of a B2B purchase, and at the same time allow us to inspect the item. The right to claim a material defect in an item is more precisely regulated by the provisions of the Consumer Protection Act.

  1. Delivery

Goods ordered on the website will be delivered to you as soon as possible. Orders received on weekdays will be shipped the same or the next business day after receiving the payment (if the product is in stock). If the ordered goods are out of stock, we will notify you immediately. The delivery of the goods is handled by Pošta Slovenije, an external carrier or IKI PRO delivery. Pošta Slovenije usually delivers the next day, but no later than 3 business days from the dispatch of the goods. The delivery employee will most likely look for you at home with the shipment in the morning, if you are not at home, they will leave you a message. The external carrier or IKI PRO delivery usually delivers within 5 business days. We reserve the right to change the contractual partner for the delivery of shipments.

We forward your information to the companies responsible for sending packages, if necessary (name, address, possibly telephone number for arranging delivery times). We forward your information to the bank for payment purposes. We do not forward the information to anyone else. In accordance with Article 73 of the ZVOP-1, the user may at any time, in writing or in another agreed manner, request that the personal data controller permanently or temporarily cease using your personal data for direct marketing purposes.

Due to the specifics of the business process and technical limitations, it is possible that you will still receive an email with advertising offers and other content from IKI-PRO within 15 days of your unsubscribe date (if the email has already been sent or is in the sending phase).   1. Complaints and disputes

The provider complies with applicable consumer protection legislation. The provider makes every effort to fulfill its duty to establish an effective complaints handling system and to designate a person with whom, in the event of problems, the buyer can contact by phone or e-mail.

The provider will confirm within five working days that it has received the complaint, inform the buyer how long it will take to handle it and keep him informed about the progress of the procedure. The provider is aware that the essential characteristic of a consumer dispute, at least as far as judicial resolution is concerned, is its disproportionality between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle to the consumer not initiating a dispute before the court. Therefore, the provider makes every effort to resolve any disputes amicably, to which the seller is also obliged by point 11 of Article 43b of the ZVPot .

For a shorter explanation and simpler resolution of complaints, we recommend that you contact us so that we can resolve the complaint or grievance quickly.

The initiator undertakes to first attempt to resolve any dispute with the consumer out of court and only after exhausting all other legal options through legal channels.

 

 

Warranty conditions

The warranty period begins on the date of sale and is valid for 12 months, unless otherwise stated for a specific product.

The company IKI-PRO doo (hereinafter referred to as the "importer") guarantees the buyer flawless operation within the warranty period of 12 months from the delivery of the product, unless a longer warranty period is legally stipulated for the product.

To claim the warranty, the buyer must present the invoice and warranty card for product identification.

In the event of any intervention in the machine without the importer's approval, the warranty will be void. The exception is the procedures specified in the instructions for use, if carried out in accordance with the instructions.

The warranty is only valid if the machine is used correctly and as permitted.

The warranty is valid only in the Republic of Slovenia.

The warranty does not apply to:

  • Errors resulting from improper handling (e.g. procedures not specified in the instructions for use).
  • Defects resulting from repairs, modifications, improper cleaning, etc., carried out by unauthorized persons.
  • Damage resulting from fire, earthquake, flood, lightning, other natural disasters or a polluted environment.
  • Defects resulting from negligent or improper storage (high temperature, humidity) or lack of maintenance.
  • Defects resulting from wear and tear.
  • Faults resulting from foreign objects entering vital parts of the machine.
  • Cases where there are any changes to the purchase date, buyer's name, seller's name or serial number on the warranty card.
  • Inadequate transportation by the buyer (e.g. damage to the product after receipt, exposure to moisture, condensation, rain, snow, hail or improper handling of the product).

Warranty claim:

The warranty applies to the free delivery or replacement of spare parts at the IKI-PRO doo location if the defect occurred within the warranty period.

The buyer is responsible for the delivery and collection of the product at the company's headquarters at their own expense and responsibility. The seller does not guarantee the collection or delivery of the machine under warranty.

The warranty does not cover any costs or financial losses incurred by the buyer due to a malfunction or failure of the machine.

The seller's liability under the warranty is limited solely to the repair or replacement of the machine (if repair is not possible). The seller is not liable for any other damage or loss incurred by the buyer due to a malfunction of the machine.

If the seller and the buyer agree in writing, the seller may send replacement parts to the buyer, who will replace them at his own risk.

If repair of the product is not possible within a reasonable time, the seller and the buyer shall mutually agree on further options, such as product replacement, refund or other appropriate solution.

Exceptions and application of warranty conditions:

These warranty terms apply to all products, except in cases where a specific product is stated differently on the website in the "Warranty Terms" tab or if the product does not have a "Warranty Terms" tab due to its nature. If a product is not covered by a warranty or if a different warranty term is published for the product (e.g. "B2B Warranty Terms" or "Manufacturer's Warranty"), the terms stated in the tab for the specific product apply.

For products for which the law provides for a mandatory warranty, minimum warranty periods and conditions apply in accordance with applicable regulations. In such cases, these warranty conditions apply only if they do not conflict with legal requirements.

Manufacturer's warranty:

For products for which the manufacturer provides a warranty, warranty obligations are implemented exclusively under the conditions specified by the manufacturer. IKI-PRO doo does not assume responsibility for fulfilling the manufacturer's warranty obligations. In such a case, each product has a "Manufacturer's Warranty" tab.

Voluntary nature of the guarantee:

For products not covered by a legally binding warranty, this warranty is voluntary . The importer voluntarily undertakes to remedy defects under certain conditions and does not assume the obligations that apply to legally prescribed warranties.

A factual error in B2B purchasing:

For customers purchasing as a business (B2B), the deadline for claiming a material defect is 7 days from receipt of the product . After this deadline, material defects can no longer be claimed. The buyer is obliged to check the product upon receipt and report any defects immediately.

Additional clarification:

These general warranty terms apply to all products, unless otherwise stated for each product in the "Warranty Terms" tab (e.g. "B2B Warranty Terms" or "Manufacturer's Warranty"). Buyers are required to check the warranty terms stated for each product before purchasing.
